A new “Legal Resources” page with links to some 31 documents is now available on the Synod’s website.
Those links are grouped under five tabs labeled “Church Administration,” “Facility Usage,” “Schools and Education,” “Sexual Misconduct” and “Other Topics.”
“Churches and schools face the daunting task of navigating complex legal issues,” according to an introduction on the webpage that was assembled by the office of Synod Chief Administrative Officer Ron Schultz on behalf of the Synod’s Board of Directors. “From child safety concerns to property matters, employment law, church governance and more, they are responsible for understanding and acting in accordance with applicable legal requirements.”
Schultz indicated that the new webpage is offered to help LCMS churches and schools navigate those complex issues.
“Our LCMS congregations, schools and agencies continue to reach out to us, seeking guidance on myriad legal and administrative matters,” Schultz said. “While we are not able to provide legal counsel for these entities, we certainly see an obligation to provide some guidance and resources that will assist them.”
The 31 resources include Protecting Your Ministry (From Sexual Orientation Gender Identity Lawsuits) — the downloadable manual the Synod developed in collaboration with Alliance Defending Freedom.
Also included among the resources are policies; sample policies, agreements and letters; guidelines; published articles; and other information from the Synod, Concordia Publishing House, government agencies and others.
Each of the five areas under the tabs ends with a legal disclaimer, and the new webpage’s introduction concludes with encouragement “to engage a qualified attorney who is licensed to practice law in the particular state or jurisdiction where you are located to assist with legal matters.”
The introduction notes that the Synod’s “Board of Directors is charged with serving as the legal representative of the Synod. The Board accomplishes this work through the Synod’s Chief Administrative Officer with appropriate guidance by the Synod’s duly appointed outside legal counsel.”
Schultz indicated that his office plans “to continue to expand the list of topics and materials available on this webpage, in response to questions we receive. The administration and operation of our churches and schools continues to increase in complexity, and we hope this resource is a way for the national office to help.”
